Image Rights & User-Provided Content

Lumora Home (“we”, “us”, “our”) operates in two distinct capacities, and this policy explains how each is handled.

  • Seller / retailer — for our own curated products (ready-made posters, wall art, lighting, homewares and similar artifacts) that we source, advertise, stock and sell in the ordinary course of our trading business. We supply these as the seller and stand behind them accordingly, subject to your rights under the Australian Consumer Law.
  • Made-to-order printing service — for custom visuals created in our design studio or supplied and/or uploaded by users and community creators (“User Content”). For User Content we act only as a printer and host; we reproduce artwork at the user’s direction and do not own or claim rights in it.

The sections below concern User Content (our printing-service role). They do not limit our responsibilities as the seller of our own curated products.

1.Ownership stays with the creator

The user who creates, supplies or uploads User Content retains ownership of their artwork. Lumora Home does not create, own, control, endorse or verify User Content, and does not claim any copyright, trademark, moral right or other intellectual-property right in it. In our printing capacity we act solely as a print-on-demand and hosting service that reproduces artwork at the user’s direction.

2.Licence you grant us

So that we can provide the service, the person who supplies User Content grants Lumora Home a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, print, adapt (only as needed for production and preview), publish and display that content for the purposes of operating the service, producing and fulfilling orders, and marketing the specific product listing. This licence ends when the content is removed, except to the extent we must retain copies to complete an order already placed or to comply with law.

3.Your representations & warranties

Each person who supplies, uploads or submits User Content represents and warrants that:

  • they are the sole owner of the content, or hold all rights, licences, consents and permissions necessary to reproduce, print, publish and sell it;
  • the content does not infringe the copyright, moral rights, trademark, design, patent, privacy, publicity or any other rights of any person;
  • the content is not unlawful, defamatory, obscene, hateful or otherwise in breach of our content standards (section 4); and
  • they have the right to grant the licence in section 2.

The uploader is solely responsible for their User Content and for ensuring these warranties are true.

4.Content standards — what’s not allowed

You must not supply User Content that:

  • infringes anyone’s intellectual-property or other rights, including third-party logos, brands, characters or a person’s likeness used without permission;
  • is unlawful, defamatory, obscene, sexually explicit involving minors, hateful, harassing, or incites violence or illegal acts;
  • is misleading, or impersonates a person or organisation; or
  • contains malware or otherwise threatens the security of the service.

5.Indemnity

To the maximum extent permitted by law, the uploader agrees to indemnify and hold harmless Lumora Home, its owner, employees and agents against all claims, demands, liabilities, losses, damages, costs and expenses (including reasonable legal costs) arising out of or in connection with their User Content or a breach of this policy, including any claim that the content infringes a third party’s rights.

6.Reporting infringement — notice & takedown

If you believe any User Content infringes your copyright or other intellectual-property rights, please report it promptly using the “Report This Design” option on the product page, or email us at hello@lumorahome.com.au, including:

  • identification of the work you own and the allegedly infringing item (with a link where possible);
  • your contact details;
  • evidence that you are the rights holder or authorised to act for them; and
  • a statement that you believe in good faith the use is not authorised by you, the rights holder, or the law, and that the information you provide is accurate.

On receipt of a genuine, substantiated claim we will promptly review and remove or disable the item. We may pass your report (and contact details) to the uploader so they can respond. If the uploader provides a valid counter-response demonstrating they hold the necessary rights, we may reinstate the content and will let you know.

7.Moderation, removal & repeat infringers

We may screen, moderate, refuse, remove or stop printing any User Content at our discretion — including where we receive a rights complaint or reasonably suspect infringement or a breach of our content standards — with or without notice. We may suspend or terminate the accounts of users who repeatedly or seriously breach this policy.

8.Our own intellectual property

Our brand, name, logo, website, product photography of our curated range, and the design and arrangement of this site are owned by or licensed to Lumora Home and are protected by law. Nothing in this policy grants you any right to use them without our prior written permission.

9.Liability

To the maximum extent permitted by law, Lumora Home accepts no liability for User Content or for any loss or damage arising from it, and any liability we do have is limited to re-supplying the relevant service or the cost of doing so. Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded.

10.Governing law

This policy is governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
